Nakedsleep.com Terms and Conditions

Nakedsleep Limited (“we”, “us”, “our” or “nakedsleep.com”) have tried to make using  the nakedsleep.com website as easy as possible, but there are some things you need to know. All bookings made through nakedsleep.com are subject to the following terms and conditions (“Terms and Conditions”). By making a booking through nakedsleep.com, you agree to be bound by these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions, you should not make any bookings through nakedsleep.com:

1. General

1.1 All nakedsleep.com bookings are non-refundable, unless you are entitled to a refund under law.

1.2 Payment is required at the time of booking; no reservations can be made without an acceptable form of payment.

1.3 Customers will not be accepted and checked into the accommodation facility without a valid booking reference number. You are required to produce the booking reference number when checking in or you will be turned away. By making a booking, you agree that by not producing a valid booking reference, you will not be allowed to check in and will not be entitled to a refund of this booking (unless required by law).

1.4 A valid government issued photo ID is required on check-in

1.5 You are solely responsible for checking that all details of your booking are correct. If you have made an error with your booking (“Incorrect Booking”) you can make an entirely new booking (“Correct Booking”) and receive a refund of the price of the Incorrect Booking (but not the booking fee) provided that you contact us within 2 hours of making the Incorrect Booking. You will need to advise us of both booking numbers (both the Incorrect Booking and Correct Booking).

Alternatively, should you have made an Incorrect Booking and wish to change the Incorrect Booking (without making a new booking) you may do so if you have more than 24 hours before the time you are required to check-in, as specified on the Incorrect Booking. This can be done by contacting us via the contact us form. Please note, by doing this, you will not be entitled to any refund (unless required under law) as the Incorrect Booking will be replaced by the Correct Booking that you have made. 1.6 Nakedsleep.com does not offer insurance of any nature or in any circumstance, customers should arrange their own insurance if they need this protection.

1.7 Nakedsleep.com is a low cost, no frills service. As such we aim to provide a safe and comfortable service. We maintain our low cost by having a simple system. Therefore we are not able to provide extra or different services to those advertised in this website. For example, we do not provide meals, airport shuttles or wake up calls.

1.8 If you are booking for more than one guest in a dorm-style property please book together as one booking. Nakedsleep.com will endeavor to put group bookings in the same room.  However,  we cannot guarantee group bookings to be placed in the same room due to factors such as availability.

1.9 All prices are shown in New Zealand Dollars (NZD) and are inclusive of GST and are subject to change without notice.

1.10 $15 bookings are only available in hostels and are strictly limited. $15 bookings are only available on confirmed and released booking dates available as per our website at the time of your viewing or booking.

2. Changing a booking

2.1. If you wish to change your booking to another date or location, you will need to make a complete new booking for the correct date or location. Note: a booking fee is added to the booking price which is non-refundable. (see table of fees here)

Once you have made the correct booking email us both the old and new reference numbers. We will then process a refund for the booking with the lower dollar value, less the change booking fee  and the booking fee. (NOTE: changes must be made and nakedsleep.com advised of these changes at least 24hours before the check in time stated on your confirmation). (see table of fees here)

You must advise us of the changes that you wish to make to your booking either via our contact us form or by phoning 0900 62533. Please note that there is a fee to the caller for using this 0900 number.

You cannot “split” a booking. So if you have a booking for two guests, you cannot change your booking for one of the guests only. If you change bookings to fewer guests than on the original booking, you will forfeit the other bed. For example if you change from two guests to one guest, you will forfeit one bed.

2.2. Changes to any booking must be done at least 24 hours before check-in time of the original booking.

2.3. Customers cannot change two or more bookings to be combined for a more expensive booking.

3. Refunds

3.1. Refunds are not given if a customer fails to check-in to a nakedsleep.com accommodation facility (unless required by law). If you are not checked in at a facility between the check in time stated on your booking and 11.59pm of the same day, your booking for that night will be forfeited and we may offer that accommodation to another person. No exceptions will be made.

4. Factors outside our control

4.1. Should weather conditions, or any other events outside our control cause a nakedsleep.com property to close, nakedsleep.com will not be responsible for the costs of transportation, accommodation, meals and incidentals. nakedsleep.com will not be liable or responsible for onward journeys or connections under these conditions.

4.2. Should you not be able to reach your accommodation for any reason, nakedsleep.com will not provide refunds (except as required by law).

4.2.1. If you are not travelling with nakedbus.com to our nakedsleep.com accommodation please take up your claim with either your transport or travel insurance provider.

4.2.2. If you are travelling on a nakedbus.com service and are unable to reach your nakedsleep.com accommodation within the specified check-in period due to severe weather conditions or any other event outside our control causing your nakedbus.com service to be cancelled or delayed (for example, if such event causes a nakedbus.com service to break down), then we will happily rebook one night’s accommodation for a date of your choice (providing we have the capacity available).

4.4. To the maximum extent permitted by law, we will not be liable for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events which are beyond our control.

4.5. We will attempt to notify you by the means that you have provided us at the time of booking. We advise you to check your email and cell phone prior to arrival to ensure there have been no changes. It is a condition of booking your reservation that you provide us with your contact details and we will not be held responsible for any consequential effects from changes to your booking, should you not receive notification of the changes.

5. Terms of stay

5.1. Nakedsleep.com has the right to refuse accommodation if the staff feel that your behaviour will harm yourself or others, or otherwise cause a disturbance. No intoxicated customers or customers under the influence of a substance that has impaired their judgement will be accommodated. You may be refused accommodation if you are carrying alcohol or any illegal substance or dangerous weapons into the facility.

5.2. If a nakedsleep.com operations team member or accommodation management feels that your conduct in the accommodation facility is endangering yourself or others around you or is otherwise causing a nuisance, the team member has the right to immediately remove you from the facility.

5.3. No customer is permitted to stay in one accommodation facility for longer than 10 consecutive days.

5.4. If you book through Nakedsleep.com and stay for 10 consecutive nights at a property, Nakedsleep.com has the right to dismiss (or cancel) future bookings at this property within 30 days of your last booking

5.5. If you are booked into an accommodation facility for more than one night and for any reason are unable to check in on the first night you must contact us at least 24 hours before the check-in time on your booking and advise us of the date that you will be checking in. Contact us using the contact us form or by phoning 0900NAKED (62533) – please note that there is a fee to the caller for using this 0900 number.
If you fail to advise us of a later arrival date you will forfeit all of the nights in your booking. If you want to check in at a later date you will forfeit any of your earlier nights’ accommodation.
Remember you can change a booking more than 24 hours before the check-in time on your booking.

6. Property

6.1. All luggage and personal items and property must be clearly labelled with the customer’s name and a physical address within New Zealand, phone number and email address.

6.2. Nakedsleep.com will not be responsible for any lost or stolen goods.

6.3. The following items are prohibited from being brought into any nakedsleep.com facility:
- Flammable liquids
- Explosives (including fireworks)
- Poisonous/toxic substances
- Solvents
- Fuel
- Any form of firearm/gun/weapon, whether in a case or not, whether in working order or not
- Any other items deemed unsafe by the front desk staff.

7. Children

7.1. Children under the age of 18 are not permitted to stay in any accommodation facility without being accompanied by a parent or legal guardian.

7.2. If you wish to stay at any accommodation facility with children under the age of 18, you must book a private room or you must book out the entire available room.

8. Other

8.1. All of our facilities are smoke free, smoking is not permitted in the rooms of any nakedsleep.com facility. There may be designated smoking areas, check with front desk staff on arrival.

8.2. Animals are not permitted in any nakedsleep.com facility, with the exception of guide dogs. Please notify nakedsleep.com of the presence of your guide dog at the time of booking.

8.3 No agent, contractor or representative of nakedsleep.com has authority to alter, modify or waive any provision of these Terms and Conditions.

8.4 Nakedsleep.com reserves the right at any time to modify these Terms and Conditions and to impose new or additional terms or conditions on your use of the nakedsleep.com service. Such modifications and additional terms and conditions will be effective immediately and incorporated into these Terms and Conditions.

9. Liability

To the maximum extent permitted by law:

(a)     the total liability of nakedsleep.com (and its contractors and agents) for any costs, losses, damages or expenses incurred by you or any other person is limited to the amount paid by you for the service in respect of which such liability arises; and

(b)     nakedsleep.com (and its contractors and agents) will not be liable for any indirect or consequential loss or damage.

If you hold yourself out as acquiring nakedsleep.com services for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply.

10. Price Beat Guarantee

You must have already made a nakedsleep.com booking.

You must notify nakedsleep.com of the details of the lower comparable online price. Details to include: a print screen of the comparable price, proof that the accommodation was available for booking, the web address of the website where you found the price, the date and time of when you found it.

Accommodation only bookings – this offer applies only to accommodation offered by nakedsleep.com. See nakedbus.com for the bus service price beat guarantee.

Ticket class – Based on any available online adult price of any accommodation competitor. Excluding free nights and prices that cannot be purchased individually.

Availability – the comparable price must be available for booking at the time that you discovered the lower fare.

Comparable accommodation – the applicable accommodation provided by the competitor must be within 2km from the nakedsleep.com accommodation and in the same accommodation class and rating.

For the purposes of verifying the difference in price, all applicable surcharges, fees, taxes and additional amounts charged in relation to making a booking will not be included. Only the price of the nights will be included. The lower price that applies must be a price offered directly by a competitor on its website and excludes any deals offered by that competitor through a third party (including one-day-deal or volume purchasing websites).

You may claim up to a maximum of 10 nakedsleep.com prices for up to 10 guests when making a claim under this promotion.

Refunds will be given in the form of a credit which you can use towards future bookings (you must use up this credit within 12 months of the original departure date). We may also (at our sole discretion) provide refunds to your credit card or nominated NZ bank account.

Nakedsleep.com reserves the right to withdraw this price beat guarantee without notice.

CERTAIN LEGISLATION INCLUDING THE CONSUMER GUARANTEES ACT 1993 MAY LIMIT THE ABILITY TO EXCLUDE LIABILITY OR MAY IMPLY WARRANTIES OR CONDITIONS OR IMPOSE OBLIGATIONS WHICH CANNOT BE EXCLUDED, RESTRICTED OR MODIFIED EXCEPT TO A LIMITED EXTENT. THESE TERMS AND CONDITIONS MUST IN ALL CASES BE READ SUBJECT TO THESE STATUTORY PROVISIONS. IF THESE STATUTORY PROVISIONS APPLY, TO THE EXTENT TO WHICH NAKEDSLEEP.COM IS ENTITLED TO DO SO, NAKEDSLEEP.COM LIMITS ITS LIABILITY IN RESPECT OF ANY CLAIM UNDER THOSE PROVISIONS TO (AT NAKEDSLEEP.COM’s OPTION) THE SUPPLY OF THE SERVICES AGAIN OR THE PAYMENT OF THE COST OF HAVING THE SERVICES SUPPLIED AGAIN.
